Authority
Which sole-source rule applies depends on the buying agency.
Many agencies, including DoD, DHS and GSA, now apply a revised FAR Part 19, where SDVOSB sole-source awards fall under 19.106-3. Agencies that have not adopted it still use FAR 19.1406. Both texts cap an award at $5 million, or $8.5 million for a manufacturing requirement, and require, among other conditions, that the contracting officer not expect offers from two or more SDVOSBs. VA awards SDVOSB sole-source contracts under 38 U.S.C. 8127 and VAAR 819.7008, with a $5 million cap for any requirement.
